Manuel C. Loja, 26, appeared in Sleepy Hollow Court on charges of operating a vehicle with suspended registration, being an unlicensed driver and operating a vehicle without insurance. There was confusion as to whether Loja had been sentenced. He had previously pleaded guilty to driving without a license.
Was he actually sentenced or can we sentence him now? Assistant District Attorney Robert Docherty asked.
After it was determined that Loja had not been sentenced, Village Justice Andres Valdespino sentenced him to time served and closed Sleepy Hollows case against Loja. He noted that Loja still had an ICE hold against him.
Fleming Sentenced Teron A. Fleming, 35, was sentenced to 30 days in jail after pleading guilty to a charge of false personation. The District Attorneys office dropped a charge of aggravated unlicensed operation of a motor vehicle in the third degree.
Fleming was pulled over on Beekman Avenue in May when he told police his name was John Johnson.
Cardoso Sentenced Richardo J. Cardoso, 26, was sentenced Monday. Cardoso had been found guilty of harassment in a non-jury trial on May 23. Valdespino ordered Cardoso to pay a $250 fine and follow a permanent order of protection which covers three years.
Criminal Contempt Susan P. Paolantonio appeared in court on two separate charges of criminal contempt after a warrant was executed. Paolantonio had failed to pay a $125 surcharge for her first criminal contempt charge, which was in November. Paolantonio said she was ready to pay the surcharge Monday.
Paolantonio was arraigned on the second criminal contempt charge on Monday as well. She pleaded not guilty, and her case was adjourned until July 11.
Drug Charges Robert L. Smith appeared in court Monday on charges of possession of marijuana, criminal trespass, appearance in public under the influence of narcotics or a drug other than alcohol and disorderly conduct.
The charges stem from three separate incidences, and Docherty said the District Attorneys office was reevaluating an offer on the first three charges based on Smiths newest charge of disorderly conduct.
Docherty said looking at Smiths charges, he had been remiss and he felt compelled to make a referral to TASC for drug counseling.
Smith entered a plea of not guilty and his case was adjourned to July 18.
Traffic Charges Misty M. Mantey, 28, pleaded not guilty to charges of aggravated unlicensed operation of a vehicle in the third degree and operating an unregistered vehicle.
Mantey said she was pleading not guilty because she didnt realize it was a criminal offense and she needed legal advice. Justice Valdespino adjourned Manteys case until July 11 to allow her to speak to someone.
Mota Trial Date Set Kennedy D. Mota, 34, rejected a plea offer from the District Attorneys office and scheduled a jury trial for September 20. Mota is charged with criminal possession of a controlled substance in the fifth degree and criminal possession of a controlled substance in the seventh degree.
Kirby Pleads Guilty James Kirby, 40, pleaded guilty to reduced charges of driving while ability impaired. He will appear in court on August 25 for sentencing.
Blacknell Pleads Guilty Dafon S. Blacknell, 26, pleaded guilty to a reduced charge of criminal trespass in the third degree.
For several incidents, Blacknell had previously been charged with facilitation in the fourth degree, trespassing, two counts of criminal trespassing in the third degree, criminal possession of a controlled substance in the seventh degree and two counts of possession of marijuana in the fifth degree.
Blacknells guilty plea will cover those charges. A separate assault charge will not be satisfied by his plea.
Blacknells case was adjourned until June 27.
Garcia Offered Plea Juan A. Garcia, 28, received an offer from the District Attorneys office to plead guilty to false personation. The plea would mean Garcia would pay a fine. Garcia, who is already on probation in Connecticut, would have to stay on probation.
Garcias case was adjourned until July 11 so that he could discuss the offer with his lawyer.
