Judge Blocks Mayor Bloomberg's NYC Ban On Large, Sugary Drinks

NORWALK, Conn. -- A New York State Supreme Court judge Monday invalidated Mayor Michael Bloomberg's planned ban on sugary drinks, which was slated to take effect Tuesday.

Manhattan state Supreme Court Justice Milton Tingling ruled that rules of the law, which was to go into effect Tuesday, are "arbitrary and capricious," applying to only certain beverages and only certain stores, Fox News reported.

Bloomberg continued to defend the ban on Twitter after the ruling.

"Obesity kills more than 5,000 NYers each year. We must take bold steps to fight this crisis," he wrote.
